The process
Negotiations with lawyers can take place by correspondence, one or more round table meetings or simply via video or audio calls.
Even if the couple is estranged, negotiations with lawyers can be useful in reducing and narrowing down problems. Constructive negotiations can be useful for setting a positive tone, with a focus on agreement.
Suitable circumstances
Negotiation with a lawyer is particularly suitable for situations where the parties are on friendly terms.
It can also be particularly suitable for separated couples:
- where there is a desire to reach an agreed settlement, rather than having a tax
- where there is broad agreement on the general principles, but several details need to be worked out
- in cases where an RMR has 'crashed', meeting in one place can focus everyone's attention.
Round table
A Round Table Meeting (RMR) involves both parties and their respective lawyers sitting around a table to try to reach an agreement on their financial and/or children's issues.
Normally, both parties will have their own room, so they can talk confidentially and ask their lawyers for advice. There will also be another room where everyone (or just the solicitors) can meet to negotiate.
An RMR can be useful to break a deadlock in negotiations or to narrow down issues. Often, clients feel they need the support of a lawyer present to help negotiate and advise them, but they like the idea of reaching a personalized solution with their spouse or partner.
Benefits of an RMR
- 'Confidential and without prejudice ' - this usually means that the ideas discussed cannot later be used against either party if there are future legal proceedings, so the negotiations are more open.
- Privacy - the RMR venue will be much more discreet than a busy court building.
- Comfort - it can take place in a more comfortable environment than in court, for example in the lawyer's office or in a hotel meeting room with refreshments.
- Work at your own pace - an RMR can be booked on a date of your choice and at relatively short notice to deal with an immediate problem, such as arrangements for imminent school vacations.
- On their terms - both parties are directly involved in the discussions, although they are also supported by their lawyer. As a result, they often feel empowered and more positive about moving forward.
